The implementation of the Alien Enemies Act of 1798 (AEA) by the Trump administration facilitates the fight against the Tren de Aragua by classifying this transnational criminal organization as a hostile representative of Nicolás Maduro’s regime, allowing for its swift expulsion and prioritizing public safety and national security in the United States.

This is supported by a report from the Center for a Secure Free Society (SFS), experts on national security in the U.S. combating transregional threats in the Western Hemisphere.

The report indicates that the AEA classifies the Tren de Aragua as a hostile agent of Maduro’s Venezuelan regime, simplifying security measures regarding immigration by eliminating bureaucratic and legal obstacles for this specific group of illegal immigrants from Venezuela, specifically the members of the Tren de Aragua.

Threat to U.S. Security

The SFS report highlights the U.S. government’s perspective, which sees recent criminal illegal immigration—particularly from Tren de Aragua members—as a serious threat to national security, qualifying it as a form of asymmetric warfare.

The application of the AEA serves as a legal tool to address this threat, enabling the expedited removal of criminals.

Tren de Aragua: Agents of Maduro’s Regime

The report emphasizes that the Tren de Aragua is a criminal entity, precisely the type that the AEA is designed to address, qualifying the Tren de Aragua as a “proxy” or hostile agent of Nicolás Maduro’s Venezuelan regime.

The report notes that between January 20 and April 25, the implementation of the Alien Enemies Act (AEA) has resulted in 489 arrests of Venezuelans associated with the Tren de Aragua engaging in criminal activities across 23 states in the U.S. Additionally, 2,329 of these criminals were deported.

It points out that the AEA distinguishes recent illegal criminal invasions and emphasizes the use of mass migration by state and non-state actors as a form of asymmetric warfare.

Expedited Removal of Criminals

The report from the Center for a Secure Free Society states that the AEA is a tool for the removal of specific illegal foreign criminals, in this case, the members of the Tren de Aragua, an organization designated as terrorist by the Trump administration through an Executive Order.

In this regard, the Alien Enemies Act streamlines deportation processes for individuals considered criminal threats. “The AEA speeds up immigration security by cutting bureaucratic and legal barriers, applied to a specific group of illegal foreign criminals from Venezuela who have committed horrid crimes in the U.S. and elsewhere,” the report states.

This distinction focuses the government’s actions on these individuals from Venezuela with criminal backgrounds.

Instrumentalized Criminal Invasion: Asymmetric Warfare

Experts from the SFS emphasize that the AEA “distinguishes recent illegal foreign criminal invasion from prior illegal immigration, highlighting mass migration instrumentalized by state and non-state actors as a form of asymmetric warfare.”

This clearly represents a strong statement framing recent illegal immigration—especially criminal activity, particularly by Tren de Aragua members—not merely as a migration issue, but as a warfare tactic used by other actors, namely, the criminal regime of Nicolás Maduro.

Trump’s Commitment

The SFS report mentions the implementation of the Alien Enemies Act (AEA) to combat the Tren de Aragua as part of the Trump administration’s commitment to protecting Americans.

“The AEA underscores the Trump administration’s commitment to using every available legal mechanism to protect the security and well-being of Americans and secure the homeland from foreign and domestic threats,” the SFS report states.

The Center for a Secure Free Society links the application of the AEA with the firm stance on border and national security taken by the Trump administration, emphasizing the fight against the influence of China, Russia, Iran, and the convergence of transnational organized crime and international terrorism.
