Leroy Garrett and Petroamigos continue to push for a review of the court decision that excludes them from participating in the CITGO Auction, while also requesting a suspension of any action until their appeal is resolved.
The former PDVSA workers have initiated a legal appeal aimed at modifying or overturning a prior ruling that denied a set of motions presented to the Delaware Court through additional arguments. The request pertains to the case of Crystallex International Corp against the Bolivarian Republic of Venezuela, which involves the sale of shares in PDV Holding Inc., the owner of CITGO Petroleum Corporation.
Garrett emphasizes the inadequacy of the recommendation made by the court-appointed expert regarding the CITGO auction, along with a series of circumstances and events that the court must consider.
New Evidence of Failures in the CITGO Auction
Leroy Garrett, as an interested party and representative of Petroamigos de Venezuela, notes that Gramercy’s response on August 4, 2025, to the objection from the PDVSA 2020 Bondholders reveals an excessive order proposed by the court-appointed expert for the CITGO auction. He believes this could prevent creditors’ claims against PDVH/CITGO assets, not just shares.
This aligns with the petitioner’s witness motion, presented on July 31, 2025, for Horacio Medina, Wilhelm, and Jorda, as well as the investigative motion exposing perjury by Ad Hoc PDVSA and the expert’s confidentiality.
He adds that the exclusion proposed by Gramercy supports the claims of victims against PDVH assets, reinforcing the FSIA status.
Reinforced Injustice and Corruption
Leroy Garrett recalls that the designation of the Cartel de los Soles as a Specially Designated Global Terrorist Group on July 25, 2025, by the U.S. Department of Treasury—terrorism led by Nicolás Maduro—is linked to PDVSA’s corruption, amplifying Horacio Medina’s bad faith inaction, despite union ties.
He also accuses the ignored affidavits and statements from Petroamigos of violating established jurisprudence and due process, while underscoring that jurisprudence has also established that human rights violations have no limitations.
Request for Suspension
Leroy Garrett renews the request to suspend the CITGO auction to prevent it from temporarily becoming ineffective while the appeal is resolved and unjustly affecting the 23,000 victims of the Venezuelan oil holocaust.
